WINCH IN (PTY) LTD – TERMS AND CONDITIONS

1.GENERAL
a.All Goods bought from Winch In (Pty) Ltd are sold to you in accordance with these Standard Terms and Conditions.
b.By purchasing from Winch In, it is agreed by the purchaser that the terms and conditions is accepted, and the purchaser agrees to be bound by it.
c.Any variation to these Terms and Conditions shall be inapplicable unless agreed in writing by the Supplier.

3.DELIVERY
a.Delivery will take place upon signing acknowledgement of receipt for the Goods.
b.The date of delivery specified by Winch In (Pty) Ltd is an estimate only. Time for delivery shall not be of the essence of the contract and Winch In (Pty) Ltd shall not be
liable for any loss, costs, damages, charges or expenses caused directly

5.DAMAGES AND DEFFECTS
a.Any damages to or defects in the delivered Goods should be reported to Winch In (Pty) Ltd within 2 days after acknowledging receipt of the Goods.
b.You may not withhold payment in respect of any Goods which you claim are defective.

7.RISK
a.All risk in the Goods shall pass to the Customer upon delivery.
b.Winch In (Pty) Ltd indemnify itself from any legal liabilities or costs which might arose from the Customer for any consequential, special or indirect damages which may arose in
any workmanship and fitment of the supplied Goods.

9.CANCELLATIONS AND REFUNDS
a.All Customer returns should be reported within 5 days of purchase by reporting such return to Winch In (Pty) Ltd and completing all required documentation.
b.All product return requests will be reviewed once all required documentation is received.
c.Unwanted products cannot be returned for credit.
d.Drivers/couriers are not permitted to collect products without written consent from Winch In (Pty) Ltd.
e.The Customer will be liable for cost which might arose from collection of products which was incorrectly ordered by the Customer.
f.The Goods which is approved for return, must be returned with the invoice for those Goods, be in a clean, complete and saleable order and in its original packaging.
g.No returns or refunds on discontinued stock.
h.Winch In (Pty) Ltd may at its own discretion apply handling fees to any returned Goods.
i.Winch In (Pty) Ltd will have the right to inspect the Goods upon return, and may at its discretion reject the request to return and/or credit if such damage is due to an act or
omission of the Customer.
j.Refunds, once approved will be executed in 24hours.

2.ORDERS
a.Accepted orders may not be telephonically cancelled, but should be done in writing to the e-mail addresses indicated in this terms and conditions.

4.SHORTAGES
a.The Customer will not have the right to claim against Winch In (Pty) Ltd for shortages in the quantity of Goods you have ordered unless you notify
us in writing of the shortage within 7 days after the date when the Goods were deliverd to you. Winch In (Pty) Ltd may opt to replace such
shortages or refund the purchase price which was paid for such Goods.

6.PRICE AND PAYMENT
a.The price of the ordered Goods will be the price on the price list which is in effect at the time of the order which may exclude sundry charges such as but not limited to delivery charges, value added tax etc.
b. All Goods will remain the property of Winch In (Pty) Ltd until such time it is paid in full.
c. Eft payments to clear and to reflect first in the bank before goods can be released.

8.CUSTOMER’S OBLIGATIONS
a.The Customer will provide Winch In (Pty) Ltd with any information reasonably required.
b.Comply with such other requirements as may be set out in the fitment instructions provided by Winch In (Pty) Ltd.
